Tennessee’s Zero-Tolerance Law Sets a Very Low BAC Threshold

Most people know the adult DUI limit is 0.08% blood alcohol concentration (BAC). For drivers under 21, Tennessee imposes a far stricter standard. Under Tennessee Code Annotated § 55-10-415, a driver under 21 can be charged with a BAC of 0.02% or higher. That’s a level that wouldn’t trigger any DUI charge for an adult driver. Commercial drivers face a 0.04% limit; drivers under 21 face 0.02%.

This zero-tolerance threshold means a minor can be arrested based on a very small amount of alcohol. If the BAC reaches 0.08% or higher, the underage driver is charged under the standard DUI statute and faces the same penalties as an adult offender.

Penalties Under the Underage DUI Statute

The consequences depend significantly on the driver’s age at the time of the offense.

Drivers 18 to 20: A conviction is a Class A misdemeanor. Drivers 16 to 17: The same conduct is classified as a delinquent act rather than a criminal offense, routing the case through juvenile court.

Regardless of age, a conviction under the underage statute carries a one-year driver’s license suspension. Tennessee law doesn’t provide for a restricted license during that period, so a suspended minor can’t legally drive to school, work, or any other obligation for the full year. Courts can also impose a fine, community service, and mandatory completion of an alcohol education or treatment program. A minor charged with underage DUI may also face a separate underage possession of alcohol charge arising from the same stop.

How Cases Move Through Montgomery County Courts

Tennessee juvenile court jurisdiction applies to individuals under 18 who haven’t been transferred to adult court. For those cases, Montgomery County Juvenile Court follows a structured process that differs meaningfully from adult criminal court.

Juvenile Court Options for Drivers Under 18

First-time offenders may qualify for an informal adjustment, where a youth service officer monitors a written contract for 90 days instead of the case going before a judge. Officers also have discretion to issue an informal juvenile warning citation, which requires the juvenile and parents to meet with a youth service officer rather than appear in court. Montgomery County Juvenile Court offers a class that satisfies the Drug Free Youth Act requirement for juveniles charged with alcohol offenses, and drug screening generally applies to those under court supervision.

Criminal Court Process for Drivers Age 18 to 20

Drivers age 18 to 20 don’t go through juvenile court. Their cases proceed through the standard criminal court process used for adult DUI charges, where a Class A misdemeanor conviction carries a permanent criminal record.
