Mental Health Evaluations Required for Domestic Assault Convictions

A new law just came into effect in Tennessee that could have a big impact on people charged with domestic assault. As of January 1, 2026, Tennessee courts must order a mental health evaluation for anyone that is convicted of domestic assault. This evaluation must be ordered and completed before the person is sentenced. The court no longer has discretion to waive this, even if the prosecution and defense agree. The judge will have access to the evaluation report and can use the findings when determining sentence including probation conditions, treatment requirements, or even jail time.
