Division of Property
While Patton & Pittman can draw up the papers for an uncontested divorce, most of our clients need more sophisticated legal help to sort out the estate. Mr. Pittman provides comprehensive counsel to ensure that your interests are protected:
- Retirement funds — This is often a couple's biggest asset. We can prepare or review the qualified domestic relations order (QDRO) to ensure an equitable split.
- Complex valuations — We represent many business owners and we engage professionals as necessary to determine the accurate valuation of property.
- The marital home — Will one party retain ownership of the house? If so, what will the other spouse get as a trade-off for the equity?
- Tax issues — Who enjoys the tax deduction for the children? What are the tax implications of child support and alimony?
- Military divorce — We are familiar with the federal protections and unique financial issues for Army personnel and their civilian spouses.
Alimony
The court has wide discretion when awarding alimony. Alimony is based on many factors such as income, earning capacity and child-rearing responsibilities. In the end, the court looks at (a) need and (b) ability to pay, and typically views support as a temporary bridge to financial independence. Long-term alimony is rarely awarded unless the age, health or education of the spouse prevents them from attaining self-sufficiency. We can negotiate, mediate or represent you in court in alimony issues.
