Custody Agreements vs. Custody Litigation
Determination of the primary residential parent is not based on any specific formal, but is based upon the Court’s finding of what is in the best interest of the child. However, in Tennessee, the trend is to involve both parents, as much as possible, in the child’s life. It is a better use of your time and money to focus on how you will share parenting responsibilities.
Mr. Pittman can help craft an out-of-court parenting plan that fits the concerns of everyone involved. The general trend is toward providing both parents with substantial time with the child. We encourage clients to focus on how much time their own schedule reasonably allows, and what is in the best interest of the child.
What If We Can't Work It Out?
You will have an ongoing relationship as co-parents. Custody litigation can be divisive and expensive. Mr. Pittman emphasizes putting egos and resentments aside to find solutions that foster a positive environment for the child. When there simply is no middle ground — or the other parent wants a showdown — he is an experienced trial lawyer who will hold your ground in a custody battle.
Modifying Custody or Support
A large share of our cases involve modifications or enforcement of child custody or child support. We represent either side in these disputes:
- Moving out of Tennessee with the children
- Increasing parenting time
- Obtaining full custody because of abuse or neglect
- Increasing or decreasing child support
- Failing to pay child support (contempt of court)
- Violating the parenting schedule or refusing visitation
Tennessee's Parental Relocation Act requires court approval before a parent and child can move more than 100 miles away from the other parent. We can represent the primary parent who has a valid reason for relocating, or the non-custodial parent whose relationship with the child would be damaged by the move.
We are also familiar with laws that specifically apply to members of the Armed Forces. For example, an overseas deployment alone cannot be the basis for a permanent change in custody.
